It provides an estimate of what the minimum fees (to the attorney) and commissions (to the executor) would be in an ordinary probate matter in the California courts. The executor in a probate may be referred to as an administrator in certain cases. It is according to the fee schedule outlined in the California Probate Code. Often in most probates, the fees are actually higher than estimated. Setting up a proper estate plan can avoid probate in most instances.
This calculator does not include costs for a probate. For example, there are costs for filing a petition for probate, for running legal publication and other costs.
The calculator can be used for administration of estates valued over $166,250, but less than $25,000,000. A reasonable amount is determined by the court for amounts above $25,000,000.
