Mr. Jimenez consults and provides general counsel services to financial institutions, medical practices, entertainment, retail, distribution, manufacturing, and national packaging and packaging-related businesses. Some representative cases include:
- Lead trial counsel representing Plaintiff physician in a breach of contract dispute between partners. The jury found there was indeed a contract, that Defendant breached it along with the covenant of good faith and fair dealing and his fiduciary duties to our client. The defendant’s cross-complaint was denied in its entirety. Our client was awarded a total verdict of $1,057,737.00.
- Lead trial counsel representing physicians against medical partners for breach of partnership agreement and breach of fiduciary duty. The jury found partners wrongfully dissolved the business and failed to pay income earned by the client;
- Lead trial counsel representing real property owner for claims of breach of contract, fraud, and quiet title against business partner. The jury found business partner committed fraud and awarded the title of real property to the client;
- Lead trial counsel defending against claims of undue influence, breach of contract, and breach of fiduciary duty regarding real estate and financial asset management. The jury verdict was in favor of the defense and found no liability against the client;
- Lead trial counsel representing credit card processing company against CRM vendor for misappropriation of trade secrets and unjust enrichment. The jury found vendor took the client’s proprietary information to start a competing business and awarded a multi-million dollar verdict;
- Lead trial counsel representing telecommunication manufacturer against telecommunication distributor for claims of breach of contract, fraud, and misrepresentation concerning the sale of a business. The jury awarded a verdict in favor of the client resulting in the rescission of the sale transaction and general and consequential damages to make the client whole;
- Lead trial counsel representing the property owner against the seller of the property for failure to disclose material defects;
- Second chair trial counsel representing manufacturer against a long-time employee for embezzling funds from the company. The jury awarded general and punitive damages against a former employee;
- Lead trial counsel defending against claims between manufacturer and distributor of breach of contract, conversion, and request for punitive damages. The jury awarded nominal damages against the client, no punitive damages, and substantially less than what was offered in the settlement;
- Lead counsel negotiating a favorable settlement for a buyer of real estate against seller and broker for failure to disclose material defects in the remodeling and permitting of the subject property;
- Lead counsel negotiating a favorable settlement in favor of the property owner regarding property line dispute and trespass claims;
- Lead trial counsel defending property management company for claims of breach of contract and breach of fiduciary duty. The jury found in favor of the client and awarded no damages to the plaintiff property owner;
- Lead counsel in favorably negotiating claims of trademark infringement by manufacturers against clients in the tobacco industry;
- Lead counsel favorably litigating and settling real estate dispute for quiet title and partition between multiple siblings;
