Conservatorship
A conservatorship is a legal proceeding to appoint a guardian for an adult who is unable to make medical or financial decisions due to illness, injury, or developmental disability. Often initiated by a family member, it may also be pursued by non-family members if necessary. Conservatorship is typically sought when no less restrictive alternative is available, such as when the person has not set up a durable power of attorney or advance health care directive.
How to Avoid a Conservatorship
A conservatorship can often be avoided if the individual has valid estate planning documents, such as a revocable living trust or durable power of attorney. TLD Law attorneys can help determine whether a conservatorship is necessary or if other legal options are available.
Limited Conservatorship
A limited conservatorship is for adults with developmental disabilities who need assistance making medical or financial decisions. This process is simpler and provides court supervision while respecting the individual’s capacity. TLD Law can guide you through determining if this option is appropriate.
