California probate is the legal process through which a deceased person’s assets are distributed to their heirs or beneficiaries. This process involves validating the deceased person’s will (if one exists), identifying and inventorying the deceased person’s assets, paying off any debts or taxes owed by the deceased person, and distributing the remaining assets to the rightful beneficiaries or heirs at law, depending on whether there was a will. The will identifies the beneficiaries of the estate. If there is no will to direct who should receive the estate, we will follow California intestate succession laws to determine the beneficiaries. The probate court oversees the probate process in California to ensure that the deceased person’s wishes are carried out and that all legal requirements are met.
